The operator has not committed to continuing the mine inflow study as
required by Stipulation No. 13. Therefore, this stipulation remains in
effect.
Stipulation No. 13
THE PERtAITTEE SHALL CONDUCT MINE INFLOW STUDIES FOR ALL ACTIVE OR
UNSEALED UNDERGROUND COAL MINE WORKINGS. ANIJUAL INFLOW STUDIES SHALL BE
CONDUCTED FOR EACH ACTIVE OR UNSEALED AREA OF WORKINGS IN THE MONTH OF
JUNE, AND THE RESULTS OF EACH INFLOW STUDY SHALL BE SUBMITTED TO THE
DIVISION BY THE FIRST OF AUGUST OF THE SAME YEAR. 7HE MINE INFLOW
STUDIES SHALL INCLUDE:
A) THE MAPPING OF EACH POINT SOURCE INFLOW (I.E. FAULTS, FRACTURED
ROOF, FRACTURED FLOOR, EXPLORATION DRILL HOLE, ETC.) AND EACH AREA
WIDE INFLOW (I.E., DRAINAGE FROM SEALS TO ABANDONED MINE WORKINGS:
AREAS OF WEEPING COAL FACES, ROOF, OR FLOOR, ETC.) ON UP-TO-DATE
MINE WORKINGS MAPS;
B) PRODUCE TABLES OF ALL POINT SOURCE INFLOWS MAPPED WITH DATA ON
THEIR FLOW RATES.
C) QUALITY DATA, INCLUDING pH, ELECTRO-CONDUCTIVITY, AND TEMPERATURE
AND THE SOURCE (I.E., FAULTS, FRACTURES, DRAINAGE FROM SEALS, ETC.)
FOR ALL POINT SOURCE INFLOWS NOT PREVIOUSLY MAPPED.
D) THE SUBMITTAL OF A CONTINUOUS RECORD OF MINE DISCHARGES FOR THE
YEAR AND A HYDROGRAPH OF FLOWS.
Stipulation No. 14 was imposed upon the original permit due to the
potential for subsidence to effect the Ciruela, Pete, Apache, and Wet
Canyon Drainages. Monitoring is ongoing under Ciruela Canyon due to the
fact that the operator discharges mine water into this canyon.
Discontinuation of the monitoring under Apache Canyon has been approved
under Technical Revision No. 2 due to the fact that the operator has
already submitted flow characteristics for this canyon and no undermining
in this area is now occurring. The Pete Canyon has not been affected as
of yet and a stipulation is still in effect on this canyon. For this
reason Stipulation No. 14 is repeated herein.
Stipulation No. 14
PRIOR TO SECONDARY OR RETREAT MINING UNDER CIRUELA CANYON AND APACHE
CANYON DRAINAGES, THE PERMITTEE MUST COLLECT DATA ON THE QUANTITY OF
WATER FLOWING IN THESE DRAINAGES. MONITORING MUST BE SUFFICIENT TO
DIFFERENTIATE SEASONAL FLOW VARIATIONS.
PRIOR TO SECONDARY OR RETREAT MINING UNDER PETE CANYON, THE APPLICANT
SHALL PROVIDE A DESCRIPTION OF STREAM FLOW CHARACTERISTICS AND IJATER USE
IN PETE CANYON.
_2g_
