Proposed Decision <br />The Colorado Division of Minerals and Geology proposes to approve the application for reriewal <br />of a valid existing permit (Permit Renewal No. 4). This decision is based on a finding that the <br />operations will comply with all requirements of the Colorado State Program as found in the <br />Colorado Surface Coal Mining Reclamation Act, C.R.S. 34-33-101, et seq., and the Regulations <br />promulgated pursuant to the Act. If no request for a formal hearing is made within thirty (30) <br />days of the first publication of the issuance of this proposed decision, then this decision becomes <br />fmal. Upon submittal of acceptable surety by the applicant, the permit will be issued. The <br />permit application, all supporting documentation and any stipulations or conditions will become <br />a binding part of the permit. <br />There are no remaining stipulations carried over from previous permitting actions. The status of <br />previous stipulations are summarized below. <br />Stipulation No. 1 required that the Somerset Mine reclaimed aeeas achieve specific goals for <br />perennial cover establishment. This stipulation was forgiven on August 28, 1990. <br />Stipulation No. 2 listed specific sampling requirements for vegetation monitoring on Somerset <br />Mine reclaimed areas. This stipulation was forgiven on August 28, 1990. <br />Stipulation No. 3 required that the operator remove a specific shrub from the reclamation seed <br />mix. This stipulation was complied with on September 8, 1987. <br />Stipulation No. 4 required the submittal of a specific subsidence monitoring map. The <br />stipulation was complied with on April 8, 1984. <br />Stipulation No. 5 required that U.S. Steel demonstrate that proposed post-mining contours <br />satisfied a static safety factor of 1.3. The stipulation was complied with on April 3, 1984. <br />Stipulation No. 6 required a joint study of noise levels and noise mitigation at the Hubbazd Creek <br />fan site. The stipulation was complied with on September 8, 1984. <br />Stipulation No. 7 required the operator to submit a detailed plan for soil amendments in the Elk <br />Creek yazd area. This stipulation was complied with on November 3, 1986. <br />Stipulation No. 8 required submittal of a detailed plan and cost summary for the Elk Creek yard <br />azea. The stipulation was complied with on December 15, 1986. <br />Stipulation No. 9 required that Somerset Coal Co. submit certain specific maps and permit pages <br />for the Elk Creek yard area. The stipulation was terminated on March 1, 1990. <br />
