<br />- 5 - <br />4. The operator should describe how the well at the Hubbard Creek <br />for Station No. 2 is to be permanently reclaimed. How have the <br />drill holes south of the No. 2 pad been sealed or managed in <br />accordance with Rule 4.07. <br />5. What other drill holes or water or gas wells exist about the <br />permit area and how have they or will they be permanently <br />sealed and plugged in accordance with Rule 4.07. <br />6. Information for the current surface water monitoring plan is <br />limited. Please provide a list and an updated map showing <br />locations of streams, springs or seeps, sediment ponds, or <br />other discharge points within the surface ownership lease <br />boundary and adjacent areas which are included in the water <br />monitoring plan. Also, list the required water monitoring <br />parameters for each monitoring site. The current NP DES Permit, <br />No. CO-0000132, lists ten separate discharge points (001-010) <br />with discharge points 003-007 and 009-010 referenced to <br />sediment ponds. The Somerset Mine permit Application received <br />on September 27, 1982 by MLRD indicates a total of thirteen <br />sediment ponds have been constructed in the Elk Creek area. <br />Please identify which of the thirteen original sediment ponds <br />are included in the current permit and list their NPDES <br />discharge point identification number. Clarify why water <br />monitoring is no longer needed for the remaining sediment ponds. <br />Part II. Stipulations and Revisions Required <br />The following is a list of the status of stipulations to the permit. <br />Stipulation No. 1 - Ongoing, Pending Reclamation <br />Stipulation No. 2 - Ongoing, Pending Reclamation <br />Stipulation No. 3 - Ongoing <br />Stipulation No. 4 - Pesolved <br />Stipulation No. 5 - Resolved <br />Stipulation No. 6 - In Compliance, Action Pending <br />Part III Bond Review <br />The current performance bond was reviewed and the following <br />revisions will be needed for overhead and profit calculations. <br />1. Public Liability Insurance at 0.08 percent of total. <br />2. Workman's Compensation at 6.92 percent of payroll. <br />3. Contractors Performance Bond at 2.0 percent of total. <br />4. Job Superintendent total hours x E20/hr. <br />5. Engineering and bid specifications. Preparation at <br />5 percent. <br />6. Contractors Profit 10 percent of total. <br />
