Pendleton, Berry and Boulay:

Mountain Coal Company (MCC) appreciates the time you spent with us on November 26, 1996,
discussing in more detail the upcoming permitting at the West Elk Mme. MCC has summarized
the discussions during the meeting and requests your confirmation of the comments and
recommendations you'd made. Charlie Rehn of Harding Lawson Associates (HI,A) was present
during the discussions of the Lower Refuse Pile and the Refuse Pile Expansion. Jonathan Jones,
Jonathan Kelly, Gary Witt, Rich Duruud and John Rold of Wright Water Engineers were present
during the discussions of Box Canyon South of the Divide, and the Probable Hydrologic
Consequences revisions. In attendance from MCC were Phil Schmidt, Kathy Welt, Paige Beville,
Eric Mende, and myself.
Lower Refuse Pile TR 78 Resolution
Charlie Rehn of HLA presented the latest stability analysis conducted on the Lower Refuse Pile in
response to Tun Pendleton's concerns forwarded to Norm Every from David Berry in a letter
dated November 12, 1996. Tim indicated that we were on the right track with our analysis, but it
would be two to three weeks before Tim could fully review our submittal. Three copies of the
submittal were given to CDMG.
Refuse Pile Expansion TR Pre-Submittal
Charlie and MCC went through the drawings for the RPE. Originally, MCC planned to submit
this application by December 13, 1996, but to accommodate the Division's recommendations and
to not encumber their PR#07 review, the submittal will be postponed until January 1997. The
following recommendations were made by CDMG:
