-5- <br />Findings of the Colorado Mined Land <br />Reclamation Division for the <br />arvey ap Project <br />Explanation of Findings <br />~ Pursuant to Rule 2.02.4(3) of the regulations of the Colorado Mined Land <br />• Reclamation Board for Coal Mining, the Mined Land Reclamation Division or <br />the Board must make several written findings prior to approval of an <br />' application. These findings are based on information made available to <br />the Division that demonstrates that the applicant will be able to operate <br />~ in compliance with the Colorado Surface Coal Mining Reclamation Act and <br />the Regulations promulgated pursuant to the Act. <br />This findings docwnent is organized according to the major disciplines <br />y reviewed during the permitting process. The written findings which must <br />be made by the Division are addressed under the appropriate discipline <br />subtitle. For example, findings concerning the protection of endangered <br />or threatened fish and wildlife species will be found under the subtitle <br />of Fish and Wildlife. <br />I. Leoal and Compliance Information - Rules 2.02.3(1)(a & bl and <br />The Division has reviewed the application for compliance with the above <br />sections of the regulations. <br />The coal to be extracted and the land to be affected is owned by Ed and <br />Helen Christine "Nell" Eldridge. The legal basis for right of entry is <br />provided by a lease agreement contained in Exhibit A which names Western <br />Associated Energy Corporation, a Texas Corporation as lessee. Western <br />Associated Energy Corporation is the parent corporation of Eastside Coal <br />Company, Inc. <br />The proposed operation is in compliance with the requirements of this <br />section. <br />II. Cultural and Historic Resources - Rule 2.02.3(1)(c)(i) <br />A letter from the State Historical Preservation Officer contained in <br />Exhibit C of the application documents that the Colorado Historical <br />Society was contacted and that no significant cultural resources occur <br />within the area to be affected. <br />The Division finds that the proposed exploration area is not within a <br />Designated Natural Area or a National Natural Landmark. The proposed <br />exploration area does not contain districts, sites, buildings, <br />structures, or objects listed in the National Register of Historic Places. <br />
