mma <br />The Review Process <br />Submittal of Application <br />On January ] 0, 1996, the Division notified P&M that its permit for the Edna Mine would expire on <br />November 16, 1996. P&M was instructed that, inaccordance with Section 2.08.5(3)(f), in order to <br />continue operations beyond that date an application for renewal must be received on or before May <br />20, 1996. P&M submitted a renewal application on Mazch 8, 1996, which was deemed complete <br />on Mazch 18, 1996. P&M published a notice of the application in the Steamboat Pilot, four <br />consecutive weeks from April 18, 1996 to May 9, 1996. <br />The Division sent P&M an adequacy letter on May 22, 1996. P&M responded on October 24, 1996, <br />but their response was inadequate, so the Division sent another adequacy letter of January 14, 1997. <br />P&M responded to that letter on June 12, 1997. <br />Comments and Objections <br />No comments on or objections to the application were received. <br />Applicant Violator System Queries <br />The applicant violator system (A V S) was initially queried on May 17, 1996. In regazd to compliance <br />history, the recommendation of the system was to issue this permit renewal. A follow up <br />recornmendationfrom the Office of Surface Mining Reclamation and Enforcement (OSMRE) also <br />on May 17, 1996 was to issue the permit renewal. The system was again queried on 5 August 1997 <br />resulting in a recommendationto approve the renewal. The follow up OSMRE recommendationwas <br />to issue. <br />Division Adequacy Review and Timeframes <br />On May 22, 1996, the Division fortivazded adequacy concerns with the submittal to P&M. P&M <br />waived the mandatory decision date for the renewal (July 18, 1996) on July 9, 1996. P&M's <br />responses to the Division's adequacy comments were received on October 24, 1996. The Division <br />reviewed those responses, and transmiried additional concems on January 14, 1997. P&M <br />responded on June 12, 1997. All adequacy concerns have now been resolved. Therefore, the <br />Division proposes to approve the renewal application with stipulations, as previously stated. <br />Publication ofthis proposed decision initiates a thirty day public comment period.
