Proposed Decision <br />The Colorado Division of Minerals and Geology proposes to approve with stipulations an <br />application from the Pittsburg and Midway Coal Mining Company (P&M) for a permit renewal at <br />the Edna Mine. This decision is based on a finding that the operations will comply with all <br />requirements of the Colorado State Program as found in the Colorado Surface Coal Mining <br />Reclamation Act, C.R.S. 34-33-101 et seq., and the Regulations promulgated pursuant to the Act. <br />If no request for a formal hearing is made within thirty (30) days of the first publication of the <br />issuance of this proposed decision, then this decision becomes final. The permit application, all <br />supporting documentation and any stipulations or conditions will become a binding part of the <br />permit. <br />The following stipulation is in effect for the Edna Mine. <br />Water from NPDESpoint 007 will not be used as surface irrigation water unless the operator first <br />demonstrates and the Division finds that irrigation with that water will not result in material <br />damage. <br />The Division last made detailed findings of compliance for the Edna Mine with Permit Revision No. <br />3, approved on May 16, 1994. At that time, the Division imposed three stipulations on its approval <br />of the revision. Stipulation 31, which defined a deadline for completion of the West Ridge <br />Hydrologic Reconstruction Plan was terminated on October 31, 1995. Stipulation No. 34, <br />terminated on December 31, 1994, required that P&M sample water in permanent ponds to <br />determine whether it metthestandazdsforitsintendeduse. StipulationNo.35,whichrequiredP&M <br />to obtain storage rights for permanent pool volumes in the Center Ridge and West Ridge ponds, was <br />complied with on December 31, 1994. <br />There are no other stipulations pending. <br />Edna Mine ?
