(TMI) is hereby requesting that K-Order No. 7620997 issued October 8, <br />2006, be terminated. Trapper is making this request after over eight months of careful ongoing <br />monitoring and inspection of the area involved in and adjacent to the slide. The east panel <br />landslide area has for the most part stabilised and no longer represents a threat to the safety of <br />any person to any greater degree than that posed by routine surface mining operations. All <br />personnel and equipment originally involved in the slide azea have been safely recovered. <br />Since the slide occurred, a number of activities specifically targeting stabilization, rionitor~ng <br />and exploration measures have been authorized through a series of K-Order modifications. <br />Sinular activities will continue to be required in the future (i.e. crack sealing, drainage <br />management and exploration and monitoring work) as Trapper works to further stabilize the area, <br />evaluate the remaining coal reserves and develop plans for mining. However, given Trapper's <br />experience and the increased knowledge gained regarding the current status of the slide area over <br />the past eight months, Trapper does not believe it is necessary to continue to obtain authorization <br />for these ongoing efforts on a task by task basis through the K-Order modification process. <br />No mining activity has taken place within the east panel Landslide area since the slide occurred <br />and no mining will take place within the slide area until such time as a revised mining p]an is <br />developed for the coal resources remaining and a commensurate revised ground control plan is <br />developed and submitted to specify the ground control measures appropriate for said plan. An <br />updated ground control plan is being submitted to MSHA under separate cover that describes in <br />general terms the activities that Trapper may undertake in the east panel slide azea. This ground <br />control plan commits Trapper to resubmitting an updated plan before mining commences within <br />the east panel slide area. <br />Survey monitoring conducted throughout the slide area has shown that the majority of the land <br />mass involved has stabilized since the initial slide and is now characterized by only insignificant <br />additional movement associated with minor localized settling and/or survey precision error. <br />Survey monument 07-GX2-BM (N 402,750E 1,435,741) situated along southwestern margin of <br />S:~tifSHACOMPIK Order No. T62U997 Tertninatinn Rtyuest.doc <br />P.O.
