leaching into ground or surface waters. The material is to be kept at <br />the McClane Canyon Mine only until final approval is granted for the <br />Munger Canyon Mine waste rock pile at which time all waste will be <br />transported to the approved Munger Canyon Mine disposal site. Additional <br />information regarding underground development waste disposal can be found <br />in Section IV of this findings document. <br />XVII. Mine Facilities, Coal Handling Structures, Support Facilities - <br />0~~70~1 z nG z > >.,.~ n nn <br />The mine facilities portion of the application can be found in Section <br />2.2 of the application. The McClane Canyon operation will use the <br />load-out facilities near the town of Loma, Colorado. The Loma load-out <br />has been permitted under the Munger Canyon application. <br />The operation is in compliance with this section of the Rules and <br />Regulations. <br />XVIII. Roads - Rules 2.05.3(3) and 4.03 <br />Section 2.2.2 of Vo]ume I of the permit application contains the required <br />information with respect to access and haul roads at the McClane Canyon <br />Mine. All roads at the mine were constructed prior to the enactment of <br />SMCRA. Figure 2.2-5 of the application indicates a section of the road <br />which had to be cut into the canyon wall where the cut slopes are <br />approximately 1v:1.13h (cross-section C-C'). This slope exceeds the <br />required 1v:1.25h which is given in the Rules and Regulations. However, <br />these cut slopes are similar to the natural slopes existing above the <br />cuts in the canyon walls. <br />Because possible slides from these cut areas do not present a potential <br />for serious environmental harm and have not demonstrated instability in <br />the past, and because the applicant is required to maintain ditches and <br />roads, these excessive slopes are permissible and meet the requirements <br />of Rule 4.03.1(3)(c)(1). <br />All other aspects of road design at the McClane Canyon site are in <br />conformance with these sections of the Rules and Regulations. <br />XIX. Bonding -Rule 2.05.4(2)(b) and Rule 3 <br />Salt Creek Mining Company has posted a performance bond in the amount of <br />X53,750.00. The Division has determined that this amount will be <br />sufficient to cover the cost of reclamation at the McClane Canyon Mine. <br />Pursuant to Rules 2.07.6(2)(j) and 3.02.1(1), the performance bond in <br />this amount will be maintained on fi]e with the Division, payable to the <br />State of Colorado and the Office of Surface Mining. <br />-28- <br />
