In the sampling program undertaken, inadequate numbers of samples were <br />taken to provide the current desired levels of confidence (p greater than <br />or equal to .80 for non-herbaceous communities, d = .10, alpha = 2) for <br />the productivity of the greasewood shrubland, shadscale shrubland, and <br />juniper woodland vegetation types. <br />The Munger Canyon Mine project contains the same vegetation types and is <br />located contiguously to the McClane Canyon Mine. Abiotic factors <br />affecting the occurrence of vegetation communities are similar. For this <br />reason, data from the two mine sites for productivity of the above <br />communities were compared to determine if the communities of McClane and <br />Munger Canyon were from differing populations. It was verified <br />statistically that the McClane and Munger respective communities were not <br />significantly different in terms of vegetative productivity within the <br />bounds of each vegetative community. Data from the McClane and Munger <br />sites were combined (within communities between sites), and it was <br />determined that the combined data met confidence level requirements. <br />It was also determined that the productivity data for the reference areas <br />for the McClane Canyon vegetative communities did not meet sample <br />adequacy requirements. Due to the small area of disturbance at the <br />McClane site, the Division has determined that pre-mine productivity data <br />may be applied as reclamation success criteria. As such, a stipulation <br />was attached to the initial permit (Stipulation No. 9) directing the <br />applicant to utilize combined McClane and Munger pre-mine productivity <br />data as the measure of revegetation success (productivity component) for <br />the greasewood shrubland, shadscale shrubland, and juniper woodland <br />affected area communities. The applicant agreed to this stipulation in <br />an April 18, 1983 letter to the Division. However, the appropriate <br />portion of the permit application was not revised to reflect the <br />modification to the existing revegetation plan. Therefore, the following <br />stipulation is required: <br />7. WITHIN 60 DAYS OF PERMIT ISSUANCE, THE APPLICANT MUST REVISE THE <br />APPLICATION TO PROVIDE A STATEMENT THAT THE COMBINED McCLANE CANYON <br />MINE AND MUNGER CANYON MINE PRE-MINE DATA FOR PRODUCTIVITY FOR THE <br />GREASEWOOD SHRUBLAND, SHADSCALE SHRUBLAND, AND JUNIPER WOODLAND <br />PLANT COMMUNITIES WILL BE UTILIZED FOR THE DETERMINATION OF <br />REVEGETATION SUCCESS (PRODUCTIVITY COMPONENT) IN ACCORDANCE WITH <br />THE CRITERIA ESTABLISHED UNDER RULE 4.15.8(3)(b). <br />Based on information submitted by the applicant in response to <br />Stipulation No. 10 attached to the March 4, 1982 Findings Document, the <br />Division reviewed information present in Tables 4.5-25 and 4.5-28 and <br />determined that woody plant density sampling was adequate for the <br />Greasewood shrubland and shadscale shrubland communities. However, <br />Juniper woodland wood plant density sampling did not meet sample adequacy <br />requirements. It was determined that affected area woody plant density <br />data from Juniper woodland communities at the Munger and McClane sites <br />was not significantly different at the 95% level (alpha = 2).
