1. IF, DURING THE COURSE OF OPERATIONS, PREVIOUSLY UNIDENTIFIED <br />CULTURAL RESOURCES ARE DISCOVERED, THE APPLICANT SHALL INSURE THAT <br />THE SITE IS NOT DISTURBED AND SHALL NOTIFY THE REGULATORY <br />AUTHORITY. THE APPLICANT SHALL INSURE THAT THE RESOURCE(S) IS <br />PROPERLY EVALUATED IN TERMS OF THE NATIONAL REGISTER OF HISTORIC <br />PLACES ELIGIBILITY CRITERIA (36 CFR 60.6). SHOULD A RESOURCE BE <br />DETERMINED ELIGIBLE FOR LISTING IN CONSULTATION WITH THE REGULATORY <br />AUTHORITY AND THE SHPO, THE APPLICAN7 SHALL CONFER WITH AND OBTAIN <br />THE APPROVAL OF THE REGULATORY AUTHORITY AND THE SHPO CONCERNING <br />THE DEVELOPMENT AND IMPLEMENTATION OF MITIGATION MEASURES AS <br />APPROPRIATE. IF PREVIOUSLY UNPLANNED SURFACE DISTURBING ACTIVITIES <br />ARE NECESSARY, THE APPLICANT SHALL SUBMIT A JUSTIFICATION AND MAPS <br />SHOWING THE PROPOSED DISTURBANCE TO THE REGULATORY AUTHORITY FOR <br />APPROVAL PRIOR TO THE COMMENCEMENT OF THESE ACTIVITIES. <br />Pursuant to Rule 2.07.6(2)(e) the Division finds the applicant will not <br />adversely affect any publicly owned park or place listed on the National <br />Register of Historic Places. <br />The operation is in compliance with the requirements of this section. <br />IV. Geology -Rules 2.04.5 and 2.04.6(2) <br />The applicant has supplied a description of the geology of the permit and <br />adjacent areas in Section 2.5 of Volume I of the application. This <br />section has been reviewed by the Division to determine conformance with <br />the Colorado Rules and Regulations. A general overview of the geologic <br />environment of the site can be found in the Description of the <br />Environment portion of this document. <br />No development waste will be intentionally produced by this operation. <br />Roof falls will, for the most part, consist entirely of coal and will be <br />shipped out or will involve a small enough quantity of material to allow <br />disposal in the mine workings. If any major roof fall occurs which would <br />necessitate disposal outside of the mine, Salt Creek Mining Company has <br />proposed to dispose of the material at the waste disposal site at the <br />adjacent Munger Canyon Mine. As of the date of issuance of the McClane <br />Canyon Mine permit renewal however, the waste pile at the Munger Canyon <br />mine has not been constructed. Therefore, the applicant has requested <br />and received approval from the Division for a minor revision (dated June <br />20, 1983) to temporarily store underground development waste rock on a <br />previously disturbed portion of the McClane Canyon Mine bench. This <br />minor revision will remain in effect until the waste disposal site at the <br />Munger Canyon Mine has been constructed. <br />The applicant has provided a geochemical analysis of roof and floor <br />material in order to provide information on the nature of any mine waste <br />material produced by the underground mining operation. The analysis <br />indicates that the material is non-saline and sodic in nature. This is <br />based on the pH and sodium adsorption ratio (SAR) figures which are high <br />relative to Division guidelines. The analysis is presented on Tables <br />-7- <br />
