That when the District Engineer has been notified by a fishery agency that a <br />filling activity is adversely affecting fish or wildlife resources or the harvest <br />thereof and the District Engineer subsequently directs remedial measures, the per- <br />mittee will comply with such directions as may be received to suspend or rrodify the <br />activity to the extent necessary to mitigate or eliminate the adverse effect as <br />required. <br />1. That in the event any historical, archeological, architectural, or other cultural <br />artifacts, vestiges, or remains are found prior to, during, or after any earth dis- <br />turbance or construction activity in the proposed project area, the peimittee shall <br />immediately notify the District Engineer. <br />m. That reinforcing bars in the broken concrete riprap shall be cut off flush with <br />the concrete. <br />n. That the broken concrete riprap shall be placed in such a manner so as to provide <br />a reasonably solid mass, with no appreciable variation in thickness nor slope. <br />o. The United States shall not be responsible for damages to property or injuries <br />to persons which may arise from or be incident to the work herein authorized, nor for <br />damages to the property of the permittee, or for injuries to the person of the per- <br />mittee, nor for damages to the property or injuries to the person of the permittee's <br />officers, agents, servants, or employees, or others who are at the site of the work <br />e herein authorized, at their invitation or the invitation of any one of them, arising <br />from or incident to Government activities; and the permit tee shall hold the United <br />States harmless from any and all such claims. <br />p. That all broken concrete riprap will be cleaned of deleterious materials prior <br />to its placement in the waterway, <br /> <br />q. That broken concrete utilized for riprap shall be less than 3 feet in diameter. <br />5 <br />
