The stipulation prohibiting the location of <br />the waste disposal area closer than 100 feet to <br />County Road 78 is unjustified. Western Fuels - Utah <br />requests that CMLR and OSM remove this stipulation <br />because the rules do not apply to non-dedicated <br />R.O.W.'s. <br />Stipulation 24 & 25 <br />Two copies of "Wildlife Studies of the Moon Lake - Deserado <br />Coal Transportation Corridor" are enclosed to satisfy these <br />stipulations. <br />Stipulation 27 <br />Moon Lake Electric has given Western Fuels a drawing showing <br />the basic pole-top design that will be used for raptor <br />protection. Two copies of this drawing are attached. <br />Stipulation 30 <br />Nickens and Associates surveyed the permit area and prepared <br />a preliminary report presenting information on the final 17 <br />sites. BLM is currently reviewing this report and will <br />forward it to OSM for final agreement as to which sites <br />are potentially eligible. <br />I hope these responses adequately meet the stipulations that <br />we had to respond to within 30 days.
