• II. CRTTERIA AND SCHEDULE FOR BOND RELEASE <br />In regazd to Phase II Bond Releases, Rule 3.03.1(2)(b) states, "Up to eighty-five percent of the <br />applicable bond amount shall be released upon the establishment of vegetation which supports the <br />approved postmining land use and which meets the approved success standard for cover based on <br />statistically valid data collected during a single yeaz of the liability period". Also in regazd to Phase II <br />bond releases, Rule 3.03.1(3)(b) states "No more than sixty (60) percent of the bond shall be released <br />so long as the lands to which the release would be applicable aze contributing suspended solids to <br />streamflow or runoff outside the permit azea in excess of premining levels as determined by baseline <br />data or in excess of levels determined on adjacent nonmined azeas". <br />The reclamation plan approved in Permit C-81-019 calls for the following reclamation standards with <br />regazd to Phase II bond release: <br />1. Topsoil Replacement <br />A minimum depth of 18 inches of topsoil except for azeas within Section 11 is required. The <br />minimum depth of topsoil in Section 11 is 12 inches (PAP page 2.05-410). <br />• 2. Revegetation <br />A vegetation cover sampled to statistical adequacy [90% herbaceous cover of the reference area <br />standazd with 90% statistical confidence, Application page 8, Rule 4.15.8(3)], compazed to the <br />approved standard (PAP page 4.15-5). The approved standard is two reference azeas, one for a <br />sagebrush community and one for a mountain shrub community (PAP page 4.15-4). <br />3. Postmining Land Use <br />A vegetative community that supports [he pos[mining land use of rangeland is required (PAP page <br />4.15-1). <br />4. Suspended Solids <br />The last section of Rule 3.03.1(2)(b) states that no more than sixty (60) percent of the bond shall be <br />released so long as the lands to which the release would be applicable are contributing suspended <br />solids to streamflow or runoff outside the permit area in excess of premining levels as determined by <br />baseline data or in excess of levels determined on adjacent nonmined azeas. <br />• C-81-019, SL-03, 15 August 2001 <br />Page 5 of 10 Pages <br />
