• Histo of Bond Releases <br /> Partial Phase I Partial Phase II <br /> <br />9/25/87 Bond Release 226.4 acres 176.4 acres <br />5/11/98 Bond Release 712.1 acres` <br />2000 Bond Release A lication 762.1 acres <br /> <br />Totals: 938.5 acres 938.5 acres <br /> <br />*This application first cited 743.2 acres but was subsequently reduced to 712.1 acres. <br />Of the 762.1 acres of this partial Phase II Bond Release request, 50 acres were included in the partial <br />Phase I bond release of 9/25/87 and the remainder were included in the partial Phase I bond release of <br />5/11/98. <br />The 2000 Application for partial Phase II Bond Release, dated September 25, 2000 (Application), was <br />received by the Division on September 26, 2000. The Application was deemed complete on <br />November 21, 2000, after the Division received proof of publication of the applicant's public notice. <br />Colowyo published notice of the bond release application in Craig Daily Press once weekly for four <br />consecutive weeks, beginning September 29, 2000. Colowyo also notified, by letters of <br />• September 21, 2000, land owners within and adjacent to the mine permit azea, and other interested <br />parties of the Application, as required by Rule 3.03.2(1). <br />By letter of February 9, 2001, Colowyo was asked to revise the application using applicable reference <br />area cover data in lieu of estimated cover pazameters approved in the PAP to demonstrate compliance <br />with the requirements of Rule 3.03.1(3)(b). The applicant's response of May 15, 2001 incorporated <br />the applicable reference azea cover data, and other clarifications requested by the Division. <br />The Division received no comments, written objections, or requests for an informal conference <br />regarding the bond release application. <br />The Division scheduled and conducted a bond release inspection on the site on June 19, 2001 in <br />accordance with Rule 3.03.2(2). The inspection was not held within 30 days of the application <br />completeness date due to snow cover over the site and winter conditions. Mitch Rollings of the Office <br />of Surface Mining, Lane Osborn of the Colorado State Land Board, and Jim Kiger of Colowyo Coal <br />Company, L.P. accompanied Dan Hernandez, Janet Binns and Byron G. Walker of the Division on <br />the inspection.
