-29- The applicant has proposed a revegetation seed mix composed of predominantly native grasses, fortis, and shrubs, and provided the required justification for the use of the introduced species in the seed mix. The applicant has stated that no pest or disease control will be used on site. Noxious weeds will be controlled according to L"oloraao State University Extension Service recommendations. Weed control measures will be previously approved by the Division before implementation. The Division is requiring that revegetation of the area be monitored periodically to determine the success of revegetation efforts. The applicant has not proposed a revegetation monitoring plan, therefore, the following stipulation is necessary: Stipulation No. 5: THE PERMITTEE, IN COOPERATION WITH THE DIVISION, WILL DEVELOP, SUBMIT AND IMPLEMENT A BIENNIAL REVEGETATION h10NITORING PLAN. THIS PLAN SHALL BE SUBMITTED TO THE DIVISION NO LATER THAN 120 DAYS AFTER PERMIT ISSUANCE. In several areas of the permit, the applicant has stated that Division regulations will be superceded by Bureau of Land Management regulations with respect to the haul road across Bureau of Land Management surface. The BLM has agreed to accept Division requirements for reclamation and revegetation. The applicant has stated that a complete reclamation plan for the haul road will be submitted one year prior to the applicant's proposed abandonment of that right-of-way. XIII. Fish and Wildlife - Rules 2.04.11, 2.05.6(2) and 4.18 The Division has reviewed the fish and wildlife resources and fish and wildlife management plan contained in Section K of the permit application. The wildlife species which has the largest potential for impact is the sage grouse. The applicant has proposed several mitigation measures to insure that detrimental effects to this species are minimized. The existing power and telephone lines on site nave been constructed to minimize the hazard of raptor electrocution. If additional transmission facilities are required, they will be constructed according to REA guidelines and Environmental Criteria for Electric Transmission Systems, and designs will be submitted to the Uivision prior to construction for review. Pursuant to kule 2.07.6(2)(h), the Division finds that the mining and reclamation operations will not affect the continued existence of threatened or endangered animal species or result in the destruction or adverse modification of their critical habitats. The operation is in compliance with the requirements of this section.
