-29- <br />The applicant has proposed a revegetation seed mix composed of predominantly <br />native grasses, fortis, and shrubs, and provided the required justification for <br />the use of the introduced species in the seed mix. <br />The applicant has stated that no pest or disease control will be used on <br />site. Noxious weeds will be controlled according to L"oloraao State University <br />Extension Service recommendations. Weed control measures will be previously <br />approved by the Division before implementation. <br />The Division is requiring that revegetation of the area be monitored <br />periodically to determine the success of revegetation efforts. The applicant <br />has not proposed a revegetation monitoring plan, therefore, the following <br />stipulation is necessary: <br />Stipulation No. 5: <br />THE PERMITTEE, IN COOPERATION WITH THE DIVISION, WILL DEVELOP, SUBMIT <br />AND IMPLEMENT A BIENNIAL REVEGETATION h10NITORING PLAN. THIS PLAN SHALL <br />BE SUBMITTED TO THE DIVISION NO LATER THAN 120 DAYS AFTER PERMIT <br />ISSUANCE. <br />In several areas of the permit, the applicant has stated that Division <br />regulations will be superceded by Bureau of Land Management regulations with <br />respect to the haul road across Bureau of Land Management surface. The BLM <br />has agreed to accept Division requirements for reclamation and revegetation. <br />The applicant has stated that a complete reclamation plan for the haul road <br />will be submitted one year prior to the applicant's proposed abandonment of <br />that right-of-way. <br />XIII. Fish and Wildlife - Rules 2.04.11, 2.05.6(2) and 4.18 <br />The Division has reviewed the fish and wildlife resources and fish and <br />wildlife management plan contained in Section K of the permit application. <br />The wildlife species which has the largest potential for impact is the sage <br />grouse. The applicant has proposed several mitigation measures to insure that <br />detrimental effects to this species are minimized. <br />The existing power and telephone lines on site nave been constructed to <br />minimize the hazard of raptor electrocution. If additional transmission <br />facilities are required, they will be constructed according to REA guidelines <br />and Environmental Criteria for Electric Transmission Systems, and designs will <br />be submitted to the Uivision prior to construction for review. <br />Pursuant to kule 2.07.6(2)(h), the Division finds that the mining and <br />reclamation operations will not affect the continued existence of threatened <br />or endangered animal species or result in the destruction or adverse <br />modification of their critical habitats. <br />The operation is in compliance with the requirements of this section. <br />
