The Pazce1003 azea is a portion of the 45.1-acre azea west of RCT 53 that was granted Phase I <br />bond release (SL-02) in 1997. Shrub augmentation seedling plantings occurred in this area in <br />1996 and 1997. <br />The Division's proposed decision regarding release of reclamation liability at Hayden Gulch <br />Mine is presented at the end of this document. The proposed decision applies to the total 8.9- <br />acres of the permit area. <br />Submittal Procedures of Current Phase I/II/III Release Application and Completeness <br />Determination by the Division <br />HGTI submitted this partial Phase [and total Phase II and III bond release application following <br />the procedures described in the Act and the Regulations. The application also utilized the <br />Division's Guideline Re ag rding Selected Coal Mine Bond Release Issues, dated April 18, 1995. <br />The application, dated November 10, 2005, requested release of $27,432.27 of bond. The <br />Division received the application on November 15, 2005. The application was determined to be <br />incomplete [Section 3.03.2(1)(d)] on January 17, 2006 due to shortcomings in the public notice. <br />The application was determined to be "complete" on March ] 0, 2006 (after the Division received <br />proof of publication of a corrected applicant's public notice). <br />Public Notice <br />HGTI published a corrected advertisement (notice) of the bond release application in the <br />Steamboat Pilot once weekly for four consecutive weeks, beginning on January 29, 2006 and <br />ending on February 19, 2006. HGTI also notified landowners within and adjacent to the mine <br />permit area, and other interested parties of the application for bond release26. <br />Bond Release Inspection <br />The Division scheduled and conducted a bond release inspection on June 7, 2006. This date was <br />selected after receipt of the complete request as a time that weather conditions permitted27.
