Completion of Reclamation Operations <br />The Division finds that the permittee has successfully completed all surface coal mining <br />reclamation operations in accordance with the approved reclamation plan. After approval of the <br />final bond release, removal of permit identification signs, slump stability monitoring <br />piezometers, and slump stability movement monitoring stakes are to be removed before the bond <br />release is processed. <br />Compliance with the Rules and Act <br />The Division finds that all reclamation requirements of the Rules and the Act aze fully met. <br />Compliance with Rule 3.03.2 <br />The Division finds that the final inspection procedures of 3.03.2 have been satisfied. <br />VII. SUMMARY AND CONCLUSIONS <br />Phase I Bond Release <br />HGTI requested a Partial (final) Phase I bond release from the slump area indicated on the Phase <br />IUIII Bond Release Map (Drawing No. 1) in the bond release submittal package. This was a <br />validation that the slump area has stabilized, and was restored to previous-approved bond release <br />topography. The Division reviewed the bond release application, the mine permit, and inspected <br />the lands. Based on the review and inspection, the Division finds that the slump azea is in <br />accordance with Phase I backfill and grading requirements of the permit. <br />Phase II Bond Release <br />HGTI requested Phase II bond release from the lands delineated on the Final Bond Release <br />Application Drawing No. 1 in the bond release submittal package. The Division reviewed the <br />bond release application, the mine permit, and inspected the lands. Based on the review and <br />inspection, the Division finds that on the bond release lands, HGTI has: replaced topsoil in <br />accordance with the approved reclamation plan, established vegetation that supports the <br />approved post mine land use and which meets the approved success standard for vegetative <br />cover, and reclaimed the lands so they are not contributing suspended solids to streamflow or <br />runoff outside the permit area in excess of premining levels or in excess of adjacent nonmined <br />azeas. <br />Based on the foregoing individual findings, the Division finds that HGTI has met all the <br />requirements for total and final Phase II release of bond from the subject lands. <br />Hayden Gulch Mine Page 15 July 31, 2006 <br />SL-04 <br />
