Support of Postmining Laud Use <br />The Division finds that revegetation is capable of supporting the postmining land use. Vegetative <br />cover over the tota1355 acres of disturbed area of the mine, including the residual 8.9 acres of <br />this bond release, is composed of a variety of life forms (grasses, fortis, and woody shrubs) and <br />species. This cover appeazs to support the following wildlife that regularly has been sighted (or <br />sign found) on the block during inspections over the last few years: elk, deer, sage grouse, small <br />mammals, various water fowl and raptors. Livestock has grazed on the site numerous times. The <br />seasonality of the vegetative species appeazs to be suitable for the post-mining land use of <br />livestock grazing, rangeland, and wildlife habitat. The bond release parcel's requirements for <br />vegetation production, species diversity, and shrub stem density were based on what would be <br />necessary for supporting the postmining land use. The bond release block has met those <br />requirements. Based on the achievement of those requirements, and the observed wildlife and <br />livestock use of the site, the Division finds that the revegetation on the bond release block is <br />capable of supporting the postmining land use. <br />355 acres at the mine site <br />Documentation of the SL-03 bond release demonstrates that this erosion and sediment control <br />criteria has been met. Cessation of the water monitoring program was approvedAO. There is no <br />water monitoring requirement in the current permit. The residual pazcels were examined for signs <br />of erosion. No incident of rill or gulley erosion was recorded in records of Division inspections <br />since the SL-03 bond release. There was no rill, gulley, or other erosional features observed <br />during the final bond release inspection associated with this application. <br />V. Eligibility for Phase III Bond Release <br />Liability Periods <br />The final bond release application, dated November 20, 2005, was received at the Division on <br />November l5, 2006, and determined to be complete on March iQ 2006.
