10. The Division has examined, and is holding Aetna Casualty and Surety <br />Company, corporate surety number 6451002085846CA, in the amount of <br />$3,732,700.00 The bond is valid and the bond amount exceeds the actual <br />required amount of E156,000.00, <br />The required bond amount reflects the Division's projection of <br />reclamation costs for worst-case disturbance until final bond release. <br />On April 3, 1988, a Phase I release was approved which lowered the <br />required bond amount to E1,493,080. The bond amount was further <br />adjusted, by way of the bond adjustment process allowed by <br />Rule 3.02.2(4)(b), to E156,000. Final approval of the adjustment <br />occurred September 25, 1988. (2.07.6.(2)(j)). <br />11. The Division has made a negative determination for the presence of prime <br />farmland within the Dermit area. The decision was based on examination <br />of local Soil Conservation Service mapping, (2.07.6(21(k)). <br />12. Based on information provided in the application, the Division has <br />determined that an alluvial valley floor exists within the permit or <br />adjacent area. The alluvial valley floors exist along the Foidel Creek, <br />Middle Creek and Fish Creek floodplains. (2.07.6(21 and 2.06,8(3)(C)). <br />For additional specific findings concerning this alluvial valley floor, <br />refer to Section B, XVII of this document. <br />13. The Division hereby approves the proposed post-mining land use of <br />pastureland, It was determined that the proposed post-mine land use of <br />pastureland meets the requirements of Rule 4.16 for the permit area. <br />(2.07.6(2)(1)). <br />14. Specific approvals have been granted or are proposed. These approvals <br />are addressed in Section B of this document. (2.07,6(2)(m)), <br />15. The Division finds that the activities proposed by the applicant would <br />not affect the continued existence of endangered or threatened species or <br />result in the destruction or adverse modification of their critical <br />habitats. (2.07,6(2)(n)1. <br />16. The Division has contacted the Office of Surface Mining, Reclamation Fees <br />Branch. As of this time, Colorado Yampa Coal Co., is current in the <br />Dayment of reclamation fees required by 30 CFR Chapter VII, subchapter <br />R. On November 8, 1990, the Office of Surface Mining recommended <br />approval of this renewal. (2.07.6(2)(01). <br />- 11 - <br />
