However, I am unable to track down correspondence <br />related to this compliance and therefore unable to determine the <br />date of compliance. The Division requests MCC's assistance to <br />reconcile this stipulation. <br />7. Stipulation 13 (or Stipulation 14 from Permit Revision 4), <br />requires MCC to monitor the subsidence monitoring network using <br />conventional ground surveying techniques (Second Order, Class II, <br />techniques). While this information is contained on Page 5 of <br />Exhibit 60 of Volume 12, the sentence needs to be a commitment for <br />future surveys rather than a statement of how past surveys have <br />been done. Once this is changed the Division can terminate the <br />stipulation, otherwise it will remain active. <br />8. Stipulation 17 (or Stipulation 18 from Permit Revision 4), <br />requires MCC to submit subsidence monitoring reports on a semi- <br />annual basis. Mr. Hayes recommended that this stipulation be <br />terminated because it had been incorporated into the permit. <br />However, this stipulation has not been incorporated into the new <br />permit document. MCC should include this stipulation in the new <br />permit document or it will remain active. <br />9~. Stipulation 43 from the original permit approval or stipulation <br />~J from Permit Revision 4, states that MCC must provide a detailed <br />analysis of the potential effects of slope stability on the <br />stability of the landslide deposit located above the town of <br />Somerset. I am unable to locate any information, nor the status <br />regarding this stipulation. If MCC has completed an analysis, <br />please provide the Division with this information. <br />`10~ Stipulation 6, as listed in the 1986 Permit Renewal, requires <br />1 MCC to limit extraction beneath the waste pile and within a defined <br />buffer zone. A note from Mr. Hayes states, the Division accepts <br />' MCC's response to terminate this stipulation and that plans for the <br />waste pile and mining sequences have changed and recommends that <br />the stipulation status be changed to forgiven. What response is <br />Mr. Hayes referring to and how has MCC's plans and mining sequences <br />changed? <br />11. Stipulation 7 (or Stipulation 13 from Permit Revision 3), <br />concerns installation of electronic tiltmeter tubes downslope from <br />the toe of the proposed upper waste pile before construction. This <br />is currently is an active stipulation. MCC addressed this <br />installation in a letter to Susan (Mowry) McCannon on August 15, <br />1985. Jim Pendleton reviewed this letter on August 29, 1985 and <br />provided some recommendations to be included in the plan. If MCC <br />could incorporate these items into the permit document, in the <br />appropriate section, the stipulation could be terminated. <br />Otherwise, the stipulation will remain active. <br />
