Stipulation 13 (or Stipulation 14 from Permit Revision 4), requires MCC to monitor the subsidence monitoring network using conventional ground surveying techniques (Second Order, Class II, techniques). If MCC has completed an analysis, please provide the Division with this information. `10~ Stipulation 6, as listed in the 1986 Permit Renewal, requires 1 MCC to limit extraction beneath the waste pile and within a defined buffer zone. A note from Mr. Hayes states, the Division accepts ' MCC's response to terminate this stipulation and that plans for the waste pile and mining sequences have changed and recommends that the stipulation status be changed to forgiven. What response is Mr. Hayes referring to and how has MCC's plans and mining sequences changed? 11. Stipulation 7 (or Stipulation 13 from Permit Revision 3), concerns installation of electronic tiltmeter tubes downslope from the toe of the proposed upper waste pile before construction. This is currently is an active stipulation. MCC addressed this installation in a letter to Susan (Mowry) McCannon on August 15, 1985. Jim Pendleton reviewed this letter on August 29, 1985 and provided some recommendations to be included in the plan. If MCC could incorporate these items into the permit document, in the appropriate section, the stipulation could be terminated. Otherwise, the stipulation will remain active.
