Jan-19-2006 04:34pm From- <br />`~ <br />Right-of-Way Grant <br />page two <br />T-656 P.003/019 F-482 <br />6erial No. C-38492 <br />Approved Map: A map showing the location of the right-of-way <br />(over, above, across) the above-described public land and designated <br />by the holder as "Process Water Evaporation Pond and Transmission <br />Pipeline Iogan Wash Facility, dated May 18, 1984 is contained in <br />case file C-38492. The map attached hereto as Exhibit A shows <br />the location of the proposed facilities. <br />This right-of-way may be used only for the purposes specified <br />above. See 43 CFR 2801.1-1(b). <br />Sec. B. <br />Terms and Conditions <br />This right-of-way is granted subject to all valid rights existing on the <br />effective date it is granted and to the following terms and conditions: <br />1. The holder agrees to comply with the regulations contained in 43 <br />CFR, Part 2800, which regulations are incorporated herein and made <br />a part hereof, as well as with all State and Federal laws and <br />implementing regulations applicable to the authorized use now or <br />hereafter in force. <br />2. "The authorized officer may temporarily suspend all activities under <br />this right-of-way upon a determination that the holder is in violation <br />of the terms and conditions of this grant and that such suspension <br />is necessary to protect the public health and safety or the environ- <br />ment. <br />3. Upon written notice to the holder, the authorized officer may <br />suspend or terminate this right-of-way if he determines that the <br />holder has failed to comply with applicable laws or regulations, or <br />any of the terms, conditions, or stipulations of this grant; or <br />has abandoned the right-of-way. <br />4. The holder shall relinquish the right-of-way to the United States <br />if the authorized facilities are ao longer needed. <br />5. The United States reserves all rights in the public land affected <br />by this right-of-way not expressly granted herein to the holder, <br />including, but not limited to, a continuing right of access onto <br />the public lands and, upon reasonable notice to the holder, access <br />to any facility constructed on the right-of-way; and the right of <br />the authorized officer to require common use of the right-of-way and to <br />grant additional uses of the right-of-way for compatible purposes. <br />6. The holder shall comply with the stipulations attached hereto as <br />Exhibits B and C and made a part hereof. <br />
