Jan-16-2006 04:36pm From- T-666 P.Ol6/019 F-462 <br />~..- v <br />Exhibit B <br />Amendment to COC-38492 <br />July 20, 2005 <br />Special Stipulations <br />All requirements and stipulations of the original grant and prior amendments shall remain <br />unchanged and in full effect unless modified by stipulations is Exhibits B and C. The <br />holder shall also construct, operate, maintain and reclaim the pipeline in strict conformity <br />with the submitted application for the right-of--way, drawings and attachments, and to <br />indusUy standards. <br />2. Due to special status plants in the area of the I2/W the Grand Junction Field Manager shall <br />be notified one week in advance of any maintenance on the pipeline requiring any surface <br />disturbance. Surface disturbance outside of the existing road disturbance shall not occur <br />without prior approval of 13LM. There shall be no vertical cuts on the cut side of the R/w <br />and no side casting of material on the fill side of the 12/W. <br />Contact the Grand Junction Field Office Manager at Ieast 48 hours prior to construction <br />start date on lil.M lands. <br />4. The holder shall obtain an agreement allowing construction with all existingrights-of- <br />way holders and pipeline operators approved through sundry notice prior to any surface <br />disturbance or construction of the pipeline across or adjacent to any existing rights-of- <br />way or approved pipelines. <br />5. All construction equipment shall be clean and free of weeds and weed seeds prior to <br />moving equipment onto public lands and start of construction. Cleaning shall be <br />accomplished by pressure washing with water unless otherwise approved by the <br />authorized officer. The holder shall monitor for noxious weed infestation and shall <br />control noxious weeds on the location and access roads as duected by the authorized <br />officer. Herbicide or pesticide use shall be approved by the authorized officer prior to <br />any application. <br />6. All construction, open trenching and operations shall be performed and maintained in safe <br />and workman-like condirions, minimi2ing safety COIICerI1S. <br />7. All disturbance shall be kept within the width of the pipeline right-of--way. Disturbance <br />shall also be contained within the running surface of the mine bench access road. <br />Any cultural and/or paleontological resource (historic or prehistoric site or object) <br />discovered by the holder, or any person working on his behalf, on public or Federal land <br />shall he immediately reported to the authorized officer. The ltalder shall suspend all <br />operations in the immediate area of such discovery until written authorization to proceed <br />is issued by the authorized officer. An evaluation of the discovery will be trade by the <br />authorized officer to determine appropriate actions to prevent the loss of significant <br />cultural or scientific values. The holder shall be responsible for the cost of evaluation and <br />any decision as to proper mitigation measures will be made by the authorized officer after <br />consulting with the holder. <br />
