Rimrock Coal Company has indeed ceased to exist. <br />I have been speaking with Mark Kerr of Landmark and I understand <br />that Mark is working with your office to replace Rimrock with Leo <br />Montoya as the permit holder. Mr. Montoya is the current <br />landowner. I further understand from you that Mr. Montoya <br />appears acceptable as the permit holder at this time. Of, course <br />I understand that the Department must process and approve the <br />application. <br />A properly executed application for transfer has been signed by <br />me for Gloria Davis, witnessed, and forwarded to Mr. Kerr for <br />execution by Mr. Montoya. The application process should be <br />completed well in time to satisfy the abatement deadline of <br />August 17, 1995. <br />I had promised to forward a copy of the contract between Gloria <br />Davis and Landmark for your reference. I wanted to include that <br />contract with this letter, however, the contract was in Mrs. <br />Davis' attorneys office and had to be mailed to me. Rather that <br />wait I thought it best to mail this letter today and follow up <br />with the contract when it arrives. <br />I thank you for your patience and understanding in this matter. <br />I assure you that failure to pre-notify the Department of the <br />liquidation of Rimrock was nothing more than an oversight.
