Unfortunately I was out of town in Florida until June 14 <br />which was after the requested date of reply of June 9! Thank you <br />for allowing me this opportunity. <br />As I mentioned on the telephone, Rimrock Coal Company was <br />founded by my now deceased father-in-law Bill Davis. Controlling <br />interest in the company transferred to my mother-in-law Lucy <br />Gloria Davis after Bill's death. <br />Rimrock contracted with Landmark Reclamation to mine coal from <br />the Rimrock mine and with Landmark to complete all reclamation <br />work required in the permit once the actual mining operations <br />were completed. As you know, the mine was active extracting <br />coal for only three or so months. Extraction was terminated when <br />Landmark declined to continue under the terms of the contract. <br />Landmark was then requested to begin immediate reclamation <br />processes in accordance with that contract mining agreement. <br />They refused. A dispute ensued. The issue was finally settled <br />by Rimrock agreeing to turn over all Rimrock assets to Landmark <br />for their contractual agreement to meet all reclamation <br />requirements. The assets consisted of all the land owned by <br />Rimrock in the mine area, cash in an escrow account, and mining <br />equipment. Landmark also agreed to keep all permit requirements <br />current. <br />Sometime after the execution of this contract the Rimrock Coal <br />Company was dissolved. It was dissolved because it was Gloria <br />Davis' understanding that the corporation was no longer necessary <br />since all reclamation processes appeared to be well in hand. <br />I do most certainly understand the situation to which you refer <br />in your letter and in the Notice of Violation copied in your <br />
