Section III -Status of Stipulations <br />At the time of the permit renewal, five stipulations were in effect. To date, PWCC and the <br />Division have resolved three of the 5ve stipulations, and the Division has since imposed no <br />additional stipulations. Listed below are all of the stipulations in effect at the time of the permit <br />renewal and the status of those stipulations. <br />Stipulation No. 3 <br />IP, DURING THE COURSE OF MIMNG OPERATIONS, PREVIOUSLY uNn)ENTU'lED CULTURAL RESOURCES ARE <br />DISCOVERED, THE PERMTCTEE SHALL INSURE THAT THE STI'E IS NOT DiSIVRBED AND SHAIL NOTIFY THE COLORADO <br />DMSION OF MINERALS AND GEOLOGY AND THE UNrrED STATES OFFICE OF SURFACE MBewG (OSM). THE <br />PERMrITPE SHALL ALSO ENSURE THAT THE RESOURCE IS PROPERLY EVALUATED W TERMS OP THE NATIONAL <br />HISTORIC PuCES ELIGIBILITY CRITERIA (36 CFR 6O.G1). SHGULD A RESOURCE BE DElERMINPD ELIGIBLE i'OR <br />LISIIIJG, ON THE NATIONAL REGISTER, APPROPRIATE MTIIGATION MEASURES WILL BE DEVELOPED AND <br />IMPLEMENTED W CONSULTATION WITH THE STATE HISTORIC PRESERVATION OFFICE (SHPO), THE BUREAU OF <br />LArro MANAGEMENT (BLM), THE OFFICE OF SURFACE MwING (OSM) AND THE COLORADO DMSION OF <br />MINERAIS AND GEQT.OGY (CDMG). <br />Origination: Permit Issuance. <br />Status: Ongoing, being complied with. <br />St~i ulation No. 13 <br />A LIST OP PROPOSED SEED MIXTURES MUST BE SUBMTITED ANNUALLY TO THE DMSION FOR REVIEW AND <br />APPROVAL. THE LIST SHOULD INCLUDE PURE LM3 SEED (PLS) PER SQUARE FOOT, POUNDS PLS PER ACRE, <br />SPECIES ORIGIN, AND ACRE PSITMATES TO BE SEEDED FOR EACH MDC. <br />Origination: Permit Issuance. <br />Status: Resolved with Technical Revision No. 27, which incorporated permanent revegetation seed <br />mixture lists into the permit application package <br />Stipulation No. 17 <br />THE 11QFOOT FILL EMBANKMENT ON THE MAIN HAUL ROAD MUST BE WSPECTED ANNUALLY, OR WITHW TEN DAYS <br />FOLLOWING ANY STORM WHOSE BACKWATER ELEVATION EXCEEDS THE ELEVATION OF 6,941.1 FEET ABOVE sPA <br />LEVEL (lO-YEAR, 24-HOUR MAXIMUM STORM EVEN'i~S PROJECTED BACKWATER ELEVATION) BY A QUALIFIED <br />GEOTECHMCAL ENGINEER OR ENGINEERING GEOLOGIST.
