Section I - HistorX <br />On August 14, 1991, Peabody Western Coal Company submitted an application to renew the valid, <br />existing permit for surface mining operations at the Seneca II Mine. The application was approved <br />with conditions on January 4, 1993. The five year permit term was renewed effective February 17, <br />1992, and will expire on February 17, 1997. <br />Mining operations continue in the Wolf Creek and Wadge pits, and 5na1 grading is underway in <br />Auger Area E. <br />Two enforcement actions were taken since the permit was renewed. Both were notices of violation. <br />A description of the notices and their status follows: <br />Notice of Violation C-93-057 <br />Issued April 16, 1993. <br />The nature of the violation was: <br />"Failure to salvage topsoil before disturbance." <br />"Failure to limit disturbance to designated, approved disturbance areas." <br />The violation resulted from a slope failure in the draw between Topsoil Stockpile I1. and Pond <br />008. <br />The problem was abated when the operator salvaged topsoil from the slide azea, stabilized the <br />slope, and extended the disturbance boundary. The notice was terminated on June 17, 1993. <br />The operator was fined $500.00. <br />Notice of Violation C-93-138 <br />Issued September 30, 1993. <br />The nature of the violation was: <br />"Failure to pass disturbed area runoff through a sedimentation pond, series of <br />sedimentation ponds, or treatment facility prior to leaving the permit area." <br />The violation existed on the north side of the Wolf Creek mining area. <br />The violation was abated through installation of a ditch and berm, and the notice was terminated <br />on September 30, 1993. <br />The operator was fined $1,100.00. <br />Sencn II Mine (C-80.005) August 19, 1994 <br />Midterm Rcview 3 Third Pcrmit Term <br />
