Summary of Compliance <br />The applicants proposal will comply with 4.05.8, 4.05.10, 4.05.11, 4.05.12, <br />4.05.13, 4.05.14, 4.05.15, and 4.05.16 with proposed stipulation. <br />H. Proposed Departmental Action <br />To approve the mining and reclamation plan with proposed stipulation. <br />I. Alternatives to the Proposed Action. <br />There are few practical alternatives to the proposed mine plan. Surface mining <br />is not feasible and would create a much more significant disturbance in the <br />mine plan area. <br />The D-Portal area could be relocated so that there would be no surface distur- <br />bances to the alluvium of Scullion Gulch. However, this would not be economi- <br />cally justifiable because the applicant would have to construct vertical <br />shafts. <br />The refuse pile could be relocated as an alternative to the proposed plan. <br />However, there are no other locations for the refuse pile in the mine plan area <br />which would lesser any possible impacts. The refuse pile could be located out- <br />side of the permit area, but this would increase haulage distances and there- <br />fore costs. Impacts could be more significant at a different site. Relocation <br />of the refuse pile is not a reasonable alternative. <br />J. Environmental Impacts of the Proposed Departmental Action and of Alterna- <br />tives to the Proposed Action <br />Mining at the proposed site mdy lower the potentiometric surface of aquifers <br />within the coal bearing strata. This drawdown is expected to result in only <br />small amounts of water inflow into the mine. This water will be used for dust <br />suppression. The water bearing strata in the mine plan area have low <br />transmissivities and ground water is not utilized for any purpose. Therefore, <br />9 <br />
