periodically throughout the reclamation period and removed when the <br />appropriate regulatory authority has deemed the reclamation process <br />effective. Modified restoration plans reflecting the above <br />stipulations must be submitted to regulatory authorities within 90 <br />days of permit approval. <br />(5) The applicant must provide the regulatory authorities with plans to <br />resize the D-Portal area and DP-1 principal spillway to allow a <br />maximum head of only one foot above the riser crest or provide <br />additional freeboard between the riser crest and emergency spillway <br />crest. The revised plans should be submitted within 90 days of permit <br />approval. <br />(6) Within 30 days of permit approval, the applicant shall commit to the <br />regulatory authorities to comply with the following requirements: <br />(a) to implement sediment control measures prior to the onset of <br />J construction of the coal transport and storage area; <br />(b) to provide emergency and principal spillway outlets with <br />appropriate erosion control prior to the construction of <br />sediment ponds; <br />(c) to provide baffles on each of the Refuse Disposal Area sediment <br />ponds as necessary; <br />(d) to provide quarterly reports to regulatory authorities as <br />required by Rule 4.05.9(8) of the Colorado Regulatory Program; <br />(e) to notify the regulatory authorities within five days after <br />analytical results of surface water samples indicate that <br />noncompliance with apermit condition or applicable standard has <br />occur, as required by Rule 4.05.13(2)(a)(ii) of the Colorado <br />Regulatory Program; and <br />30 <br />
