Cattany <br />Division Director <br />Natural Resource Trustee <br />On May 4, 2007, the Division of Reclamation, Mining and Safety issued our proposed <br />decision to approve Colowyo Coal Company L.P.'s application For Permit Revision No. 2 <br />at the Colowyo Coal Mine. The public comment period applicable to the Proposed <br />Decision began at 8:00 a.m. on May 7, 2007 and ended at 5:00 p.m. on June ~, 2007. We <br />• received no requests for a Formal Public Hearing during the public comment period. <br />Colowyo Coal Company LP has filed, and the Division has accepted a corporate surety to <br />cover the full amount of reclamation bond for $83,156,939.00. Therefore, our Decision <br />has become final and we are issuing the final decision to approve PR-2. <br />Nine stipulations were attached to the PR-2 proposed decision document. Colowyo has <br />signed the revision form indicating acceptance of the stipulations. Please be aware the <br />issuance of the permit revision initiates the time frames for the stipulations. <br />A copy of this letter is being copied to the Office of Surface Mining.
