~~ <br />site plan detailing the existing natural features and show how the mining areas relate to the natural <br />landmark, and information on truck traffic. <br />County Health Department - <br />Indicate that the operation is subject to Colorado Air Quality Control Commission Regulation 3 regarding <br />the submittal of an Air Pollution Emission Notice (APEN) and the submittal of a Fugitive Dust Control <br />Plan prior to construction and operation. <br />Town of Lyons - <br />Indicate concems regarding the Reclamation Permit, question the impact of additional traffic, and drainage <br />from the mine. <br />Adjacent Property Owners - <br />Eleven Responses were received from adjacent property owners that indicate concerns with the proposal. <br />Concerns cited include the vagueness of the application, size of the proposal area, poor reclamation <br />efforts, negative economic impact on surrounding property, wildlife impacts, noise impacts, dust, road <br />damage, lack of compatibility with surrounding residential uses, visual impacts, water run-off, limited <br />impacts to east and west portions of the property, steep slopes, on-site blasting, impacts to area wells, no <br />set hours of operation, no mine plan has been submitted, insufficient reclamation plan, no information on <br />hazardous materials, no information on financial bonding or employee safety. <br />Three responses indicate support for the proposal stating that the area has been quarried for some time and <br />before the residences, the amount of extraction is not proposed to increase, and that moderate blasting <br />should not result in impacts. Two adjacent property owners indicate no conflicts. <br />Additionally, two petitions objecting [o the proposal were submitted to the Land Use Department. The <br />first petition contains 99 signatures, and the second petition contains 101 signatures. <br />The County Land Use staff finds that through our review and discussion at the Docket Review Staff <br />Meeting that the proposed development of the entire site is too intense and suggest scaling back the quarry <br />boundaries, that more details as noted in the referral responses are necessary, that a wildlife report as noted <br />in the Parks and Open Space staff referral response is required. <br />Your written response to these issues must be received by this office no later than June 28. 1999, for this <br />docket to be reviewed at the next docket review staff meeting June 30, 1999.
