Sealing of Drilled Holes and Underground Openings -Rules 2.05.9(2)(9) <br />and 4.07 <br />Information on the sealing of exploration and mine holes is found on page 2.05-59. <br />The operation is in compliance with the requirements of this section. <br />XXIZI. Subsidence - Rules 2.05.6(6) and 4.20 <br />Since this is a surface mining operation, the requirements of the subsidence <br />sections are not applicable. <br />XXIV. Special Categories of Mining other Than AVF and Prime Farmland - Rules <br />2.06, 4.22, 4.23, 4.26, 4.27, 4.28, and 9.29 <br />The applicable special categories of mini n9 at Chimney Rock Coal are steep slope <br />mining and variances from approximate original crontour restoration requirements <br />for steep slope mining. Some steep slopes exist alony the eastern mining boundary, <br />as shown on Map 12. Compliance with requirements of Ruie 9.27 are discussed in <br />Section 2.06 of the application, and under Section XVII, Backfilling and Grading, <br />of this document. <br />The operation is in compliance with the requirements of this section. <br />XXV. Miscellaneous Compliance - Rules 2,05.6(5), 9.02, 9.12, 4,29, 9.21, <br />9.23, and 4.30 <br />No problems were identified with respect to the requirements of these s=coons. <br />The proposed operation is in compliance. <br />X,YVI. Operations on Land Subject to Limitations or Prohibitions - RuZ es <br />2.03.7 and 2.10 <br />The proposed operation is in compliance with recuirements of these section; and <br />2.07.6(2)(d) for the following reasons: <br />The permit area of the proposal operation is not crithin: <br />a. An area designated unsuitable for mining; <br />b. an area under study for designation as unsuitable fur surface coal <br />mining; and <br />c, on any lands subject to prohibitions or limitations. <br />Chimney Rock Coal is proposing to conduct surface mining operations within <br />100 feet of the outside right-of-way of State Nighway I51. The applicant has <br />contacted t<he Colorado State Department of Highways and received the necessary <br />approval allowing the above-mentioned operations. <br />Chimney Rock Coal is proposing to conduct mininy operations within 300 feet of <br />an occupied dwelling. The applicant has acquired the necessary waivers from <br />the landowner (see Exhibit 15, Volume IV) to allocr surface mining operations <br />in proximity of the dwelling. <br />
