-zB- <br />Pursuant to the finding required by 2.07.6(2)(n), and on the basis of available <br />information, the Division finds the proposed operation will not affect the <br />continued existence of endangered or threatened species or result in the <br />destruction or adverse modification of. their critical habitat <br />The proposed operation is in compliance. <br />XIV. Prime Farmland - Rules 2.09.12, 2.06.6, and 9.25 <br />The Division has made a negative determination for the presence of prime farmlands <br />within the proposed permit area. The decision was based on the fact that there <br />are no prime farmland mapping units (see Exhibit 19, Volume Iv) and the land <br />has not been historically used as cropland. <br />The proposed operation is in compliance. <br />XV. Operations Description - Rules 2.05.2, 2.05.3(2), and 4.01 <br />The Afar tinez Strip Mine is an open pit truck and shovel operation which is <br />removing three coal sums. The overburden and interburden is blasted, Loaded <br />into trucks and transported to spoil piles adjacent to the pit. The coal is <br />then shot, loaded into trucks and hauled to the crushing facility. Following <br />crushing, the coal is stockpiled for shipment to a railhead located in <br />New Mexico via i[ighway trucks. <br />The Eastern portion of the active workings involves total extraction of all <br />three coal seams. The western expansion area (Barren Ridge area), will involve <br />partial extraction of the coal reserves in this area. Partial extraction of <br />the reserves in the Barren Ridge area is being granted at this time in <br />order to ensure that disruption to the adjacent AVF will be minimized. <br />The partial extraction scheme calls for extraction of these portions of the seams <br />above the Level of Stollsteimer Creek. In light of this the following <br />stipulation is necessary: <br />Stipulation <br />18.
