It specifically requires approval of a <br />revised backfilling and grading plan demonstrating compliance with <br />9.14 prior to any expansion of the portal bench disturbance as it <br />existed on March 12, 1997. <br />Stipulation No. 24 required certain design amendments for proposed <br />reclaimed channel segments. <br />Stipulation No. 25 required sieve analysis of coal material from <br />the Loma Loadout, to demonstrate acceptable material strength for <br />use in minesite reclamation backfill. <br />TR-12 proposed approval decision was issued July 16, 1999. The <br />revision was in response to Stipulations 29 and 25, and addressed <br />reclamation channel designs, analysis of stockpiled coal, and also <br />included an access road "statement of compliance". <br />MR-14 proposed approval decision was issued October 22, 1997. The <br />revision allowed for clean-out of flood deposited sediment and <br />debris from a segment of an ephemeral stream channel immediately <br />up-gradient from a 42 inch culvert beneath the Munger access road. <br />MR-15 application was withdrawn by the operator on October 15, <br />1999. <br />MR-16 proposed approval decision was issued July 30, 1998. The <br />revision amended the previously submitted permit area legal <br />description to correct certain minor discrepancies. <br />SO-2 proposed approval decision for a permit transfer was issues <br />July 15, 1999. The Decision became final, and the permit was <br />transferred from Grand Valley Coal Company to Lodestar Energy, <br />Inc., on August 17, 1999. <br />Stipulations <br />11 stipulations were attached to the SO-2 Permit Transfer decision <br />(1, 3, 5, 7, 12, 19, 15, 16, 17, 20, and 23). All of these <br />stipulations with the exception of #23 had been attached to the <br />April 10, 1993 renewal permit (RN-02), and remain in effect. <br />Stipulation #23 was attached to TR-11, and subsequently to RN-03, <br />and also remains in effect. Stipulation 22 (attached to TR-10) and <br />Stipulations 24, and 25 (attached to TR-11), were resolved by <br />submittal of information within TR-12. <br />It is noted that Stipulations 1, 5, 14, 15, 16, 17, and 20 apply to <br />proposed haul road and mine facilities which have not been <br />constructed.
