III. SUMMARY OF REVISIONS AND STIPULATIONS <br />Revisions <br />Revisions approved subsequent to the Division's August 28, 1995, <br />mid-term review are addressed below. Technical revisions up to and <br />including TR 09 and minor revisions up to and including MR 13 were <br />addressed in that document. Since that time, three technical <br />revisions, three minor revisions, and one permit <br />transfer/succession of operator (SO), have been approved. A permit <br />renewal was approved in June 1998 (RN-03). The permit term expires <br />January 13, 2003. <br />TR-10 proposed approval decision was issued January 23, 1996. The <br />revision was submitted in response to the mid-term review. Various <br />aspects of the reclamation plan were updated, certain <br />inconsistencies regarding water sampling requirements were <br />eliminated, and tests of revegetation success were addressed with <br />more specificity. The proposed decision included one stipulation <br />(Stipulation No. 22) which required a revision addressing <br />reclamation of the existing road and portal bench disturbances to <br />be submitted prior to resumption of active status, and no later <br />than June 1, 1996. (Revision submittal deadline was subsequently <br />extended to September 3, 1996). <br />TR-11 proposed approval decision was issued March 12, 1997. The <br />revision addressed amended reclamation plans and costs specific to <br />the existing disturbance, and was in response to Stipulation No. <br />22. The revision restricted mine operations to current disturbed <br />areas, and allowed for a reduction in the reclamation bond amount <br />from $329,908.75, to $161,018.00. The Division determined that the <br />TR-11 reclamation plan for the existing mine bench and access road <br />disturbance would comply with applicable backfilling and grading <br />and stability requirements of 9.03.2 and 9.19. Reclamation of the <br />existing disturbance is addressed in Section 3.9 of the <br />application. The portion of the access road to be reclaimed, and <br />the mine bench would be backfilled, compacted in lifts and graded <br />to blend with surrounding topography, with the mine bench highwall <br />eliminated. The lower, "valley bottom" portion of the existing road <br />will be left in place in accordance with landowner request, to <br />allow for access to the stock trail extending from the canyon to <br />grazing lands higher in the watershed. The proposed decision <br />included three stipulations (#23, #29, and #25). <br />Stipulation No. 23 requires revision of the permit prior to any <br />further disturbance or resumption of active status for purposes <br />6 <br />
