,~ <br />7. OSM's records conf irm that all fees for the abandoned M'_ne Reclamation <br />Fund have been paid. (2.07,6(2)(h), 786.19(h); (Personal <br />communication vith John Sender, OSM Albuquerque Field Office November <br />30, 1982) . <br />8. OSM records show chat the applicant does not control and has not <br />controlled mining operations with a demonstrated pattern of villful <br />v±olations of the Act of such nature, duration, and with such <br />resulting irreparable damage to the environment as to indicate an <br />intent not to comply with the provisions of the Act. (2.07,6(2)(h), <br />786.19(h); (see page 9 of CMLRD's decision document). <br />9. Surface coal mining and reclamation operations to be performed under <br />the permit will not be inconsistent with the any proposed operators is <br />the Immediate vicinity of the Roadside and Cameo Mines in that none <br />are proposed. (2.07.6(2)(1), 786.19(j); (See Wage 34 of CMLRD's <br />decision document). <br />10. The analyses completed by CMLRD and OSM shoe that the bond amount will <br />be adequate. The applicant must post the petfozmance bond required <br />under the Act, the approved State program, and the Federal Lands <br />Program prior to permit issuance. The bond must be made payable to <br />both the United States and the State of Colorado in the amount of <br />$1,500,000.00. (30 CFR 742.12(b); (2.07,6(2)(j), 786.19(k); and <br />742.12 (b); (see page 32 of CMLRD's decision document). <br />11. The applicant has provided evidence and the CMLRD has found there are <br />no prime farmlands in the permit area (2.07.6(2)(k), 786.19(2) and <br />742.21(b); (See page 27 of CMLRD's decision document.) <br />12. A positive alluvial valley floor determination has been made for the <br />drainages in the proposed permit area and area for life of mine. This <br />decision holds for only the Roadside Mine. The Cameo Mine does not <br />underlie any iateffii.ttant or perennial stzeams. CMLRD has conducted a <br />detailed analysis of the alluvial valley floors in this area, namely <br />Rapid Creek and the Colorado River areas. Both vi'_1 be somevhat <br />affected but analysis has shove these effects to be negligible in <br />nature. The essential hydrologic elements of the Colorado River AVF <br />and Rapid Creek AVF viii be maintained. (2.07.6(2)(1) and'86.19(m); <br />(See pages 19-24 of C2II.RD's decision document). <br />13. The proposed postminiag land use of the permit area has been approved-~~ <br />by the CMLRD and OSM. (2.07.6(2)(1), 786.19(m); (See page 9 of <br />CMLRD's decision document). <br />14. C`II.BD and OSM have made all specific approvals required by the Act, <br />the approved Colorado state program and the Federal lands program. <br />(2.07.6<2)(m), 786.19(m); (see CMLRD's decision document). <br />15. The proposed operation vi'_1 not affect the continued existence of <br />threatened or endangered species or result in the destruction or <br />adverse codification of the'_r critical habitats.
