Water Rights and Replacement - Rules 2.04.7(3), 2,05,6(3)(a)( <br />The Division has reviewed the portions of Section 2.04.7 of the application <br />dealing with water rights for compliance with the Rules and Regulations. <br />The applicant applied for surface water rights to surface water collected <br />within sediment ponds in Hayden Gulch. This water was used for dust <br />suppression at the mine. H-G also intends to retain the sediment ponds as <br />stock ponds after mining is completed. As H-G Coal Company has junior water <br />rights, when a do~mstream holder of senior water rights puts a call on those <br />rights, no additional water can be diverted or contained by the operation <br />until the call is no longer in effect. This situation applies to both the <br />spring in Dry Creek (Spring H-G-W) and the impoundments on Hayden Gulch (ponds <br />RWD, H-G-Th, and H-G-B). <br />The applicant has stated that the majority of the water used for irrigation in <br />the Dry Creek Valley is diverted from an adjacent drainage (Sage Creek). This <br />being so, the effect of the operation on water rights in Dry Creek is <br />insignificant. <br />IVater contained within the sediment control system at the loadout will be <br />treated to meet effluent standards and released back into the natural <br />drainage. The amount of water retained for 24 to 36 hours would not affect <br />water rights. <br />There are a few registered wells within the general vicinity of the proposed <br />mine. idost of these wells lie along strike or updip of the mine or are <br />otherwise hydrologically isolated from the strata effected by the mine. One <br />well is located, downdip of the mine, but is 3.5 to 4 miles away, This tueli <br />will not be affected because the cone of depression, as calculated, will only <br />extend 400 to 500 feet beyond the pit. <br />The operation is in compliance with the requirements of this section. <br />IX. Oata supporting these statements r_an be found in <br />Appendix E (Volume III), Appendix I (Volume IV ), Appendix L (Volume V), <br />Appendix R (Volume VII), and Appendix S (Volume VII).
