<br />RMR-CURE~000-003 3 <br />9.• Authorization under this permit is limited to those activities, lands, <br />and access routes specifically described in the Formaz Plan of Operations <br />dated April 13, 1984, and in all amendments to said Plan except insofar as <br />the plan is modified by the terrns and conditions of this permit. The <br />_ issuance of this permit constitutes continued approval of the Plan of <br />Operations. Amendments will be made to this permit as conditions warrant. <br />This permit is issued on an interim basis while a new Plan of Operations <br />and Reclamation Plan are being drafted, reviewed, and approved. <br />These plans must be approved by the Superintendent as well as the State <br />of Colorado's Mined Land Reclamation Division. Anew permit will be <br />issued, or amendments to this permit will be added to cover conditions <br />of the new Plan of Operations and Reclamation Plan. <br />10. This permit is valid only for the period of time indicated, but may be <br />renewed or reissued upon a written request from the permittee and a <br />decision to do so by the Superintendent. <br />Il.s The permittee is required to meet with the Superintendent or designated <br />representative annually to discuss planned operations for the upcoming year. <br />Appropriate adjustments to this permit and to the Plan of Operations will be <br />made at this time. This meeting will take place by 15 July 1992. <br />12. This permit is issued subject to all valid existing rights including <br />those of unknown persons who may have valid interests in the lands as of <br />the date of this permit. Upon acceptance of this permit, the permittee <br />accepts all responsibility for damage to holders of valid existing rights which <br />may occur from actions taken under this permit. <br />13. In the event that this permittee/operator fails to use this permit, this <br />permit may not be transferred to any other person or firm. <br />l4. The issuance of this permit is expressly conditioned upon the <br />Superintendent, Curecanti NRA, and/or his designee having reasonable <br />access to the azea of operations as necessary to monitor and ensure <br />compliance with the Plan of Operations and stipulations. <br />IS.+ No material shall be stored, operations staged or improvements installed <br />on park-administered lands adjoining the area of operations authorized. <br />l6. All existing improvements including but not limited to fences, gates, <br />roads, culverts, and public land survey monuments shall be routinely <br />maintained in serviceable condition. Damaged or destroyed improvements <br />shall he replaced, restored and appropriately compensated for. <br />17.• All mining operation survey monuments and/or other types of survey <br />monuments, witness corners, and reference monuments must be protected <br />against destruction, obliteration or damage.
