14. Adjudication Plan <br />Update the adjudication file to reflect water court decisions since 1981 <br />per Rule 2.05.6(3)(a)(ii). <br />15. Subsidence Impacts to Area Springs <br />Exhibit 74, page 25, states that the only water right impacted by <br />subsidence is Spring G-26. Exhibit 5, page 4, states that no Boring <br />within the subsidence boundary will be impacted. These contradictions <br />need to be corrected with a deta filed discussion of their impacts. Other <br />springs in the area need to be addressed as part of this narrative in <br />compliance with Rule 4.05.13(1 )(b ). <br />Surface Water Hydrology <br />16. Location of Sediment and Drainage Control Plan in Permit Application <br />Section 2.04, page 2.04-32, states that a sediment and drainage control <br />plan prepared for the Bear Mine operation will minimize or eliminate <br />impacts to the North Fork of the Gunnison River. The location of this <br />plan in the permit should be referenced in this section. A drainage and <br />sediment control plan exists as Exhibit 11. However, this plan is no <br />longer current and should be updated or deleted and incoporated elsewhere. <br />]7. Location of Design Plans and Specifications <br />Section 4.05, page 4.05-5 states that design plans and specifications are <br />presented in Section 2.05.6. A search of this section did not result in <br />their discovery. Please properly reference the location of details <br />within the permit application. <br />18. Pond Sediment Monitoring <br />Section 2.05 outlines a plan for sediment monitoring of sediment from the <br />pond. Page 2.05-22R contains the statement that "The pond will be <br />examined periodically for structural weakness, erosion, and other <br />hazardous conditions." The timing of these inspection procedures should <br />be specified as quarterly rather than periodically as required in <br />Rule 4.05.6(10). <br />19. Pond Se dimeni Removal <br />Pages 2.05-22R and 4.05-6R contain a commiiment for annual sediment <br />removal from the sedimentation pond. Please elaborate on two items: (a) <br />What parameters are tested for with regard to determining if sediment is <br />acceptable for placment on topsoil stockpiles? (b) If a sediment sample <br />indicates that the material does not meet topsoil parameters, what <br />becomes of it? Bear Coa] should provide a narrative on its treatment and <br />disposal. <br />-6- <br />
