All pasturelands aze managed principally for <br />improved pasture species and increased hay and forage production. <br />Surface coal mining activities at Mine No. 3 occurred from 1974-1980 and <br />underground mining activities in the Middle Creek Mine were initiated in 1979. <br />The underground mine was not reactivated, but the remaining coal in the surface <br />mine was extracted during 1984 and 1985. <br />CYCC is proposing to return the reclaimed lands to the pre-mining land use of <br />pastureland. Pursuant to Rule 2.07.6(2)(1), the Division approves the proposed <br />post-mining land use. Based on the information in the reclamation plan, <br />including backfilling and grading, topsoil redistribution and revegetation, the <br />applicant has demonstrated that all areas affected by surface coal mining <br />operations can be restored to conditions that are capable of supporting the uses <br />which they were capable of supporting before any mining. The post-mining land <br />use meets the requirements of Rule 4.16. <br />The permit application is in compliance with this section. <br />XIII. Protection of Fish, Wildlife and Related Environmental Values <br />Information regarding compliance with Rule 4.18 is located at pages 2.04-79 through <br />2.04-104. The operation is in compliance with this rule. <br />X[V. Protection of Underground Mining <br />This section does not apply to Mine No. 3. <br />XV. Subsidence Control <br />This section does not apply to Mine No. 3. <br />XVI. Concurrent Surface and Underground Mining <br />This section does not apply to Mine No. 3. <br />XVII. Operations on Alluvial Valley Floors <br />Unconsolidated streamlaid deposits holding streams have been identified within <br />the proposed permit and adjacent areas, and are shown on Map 4a, Mine No. 3 <br />Hydrology. As shown on the map, three areas aze acknowledged by the <br />applicant as meeting the geomorphic criteria of alluvial valley floors. These <br />areas are: 1) the flood plain of Fish Creek; 2) the flood plain of Middle Creek <br />downstream from U.S.G.S. Gaging Station 09243700; and, 3) the flood plain of <br />Foidel Creek downstream from U.S.G.S. Gaging Station 09243900. The flood <br />plain of Fish Creek does not lie within the boundary of the proposed permit area <br />and would not be affected by the proposed mining and reclamation operations as <br />19 <br />
