The required bond amount reflects the Division's projection of reclamation costs for <br />worst-case disturbance until final bond release. On April 3, 1988, a Phase I release was <br />approved which lowered the required bond amount to $1,493,080. The bond amount <br />was further adjusted, by way of the bond adjustment process allowed by <br />Rule 3.02.2(4)(6), [o $156,000. Bond re-calculation at mid-term review in 1992 and at <br />permit renewal in 1995 both modified the required bond amount to the current figure of <br />$180,539.00 (2.07.6.(2)Q)). <br />11. The Division has made a negative determination for the presence of prime farmland <br />within the permit azea. The decision was based on examination of local Soil <br />Conservation Service mapping (2.07.6(2)(k)). <br />12. Based on information provided in the application, the Division has determined that an <br />alluvial valley floor exists within the permit or adjacent azea. The alluvial valley floors <br />exist along the Foidel Creek, Middle Creek and Fish Creek floodplains (2.07.6(2) and <br />2.06.8(3)(C)). <br />For additional specific Findings concerning this alluvial valley floor, refer [o Section B, <br />XVII of this document. <br />13. The Division hereby approves the proposed post-mining land use of pastureland. It was <br />determined that the proposed post-mine land use of pastureland meets the requirements <br />of Rule 4.16 for the permit area (2.07.6(2)(1)). <br />14. Specific approvals have been granted or are proposed. These approvals aze addressed in <br />Section B of this document (2.07.6(2)(m)). <br />15. The Division finds that the activities proposed by the applicant would not affect the <br />continued existence of endangered or threatened species or result in the destruction or <br />adverse modification of their critical habitats (2.07.6(2)(n)). <br />16. The Division has contacted the Office of Surface Mining, Reclamation Fees Branch. As <br />of this time, Colorado Yampa Coal Co., is current in the payment of reclamation fees <br />required by 30 CFR Chapter VII, subchapter R. On May 5, 1995, the Office of Surface <br />Mining recommended conditional approval of this renewal (2.07.6(2)(0)). <br />Additionally, the AVS check indicates that the following stipulation must be attached to <br />this renewal finding: <br />Stipulation No. 20: <br />THE PERMIT RENEWAL APPROVAL OF MINE NO. 3 IS CONDITIONED UPON <br />RESOLUTION OF THE PITTSTON INJUNCTION ASSOCIATED WITH FEDERAL AUDIT <br />v1oLAT1oNS VA 940103193 AND WV 940121110, CMIS VIOLATION <br />C83-013-106-002 AND FOUR (4) AML FINES FOR PERMIT VA 440558601 A. PROOF <br />OF RESOLUTION OF THIS ISSUE MUST BE SUBMITTED TO THE DIVISION AS SOON AS <br />IT BECOMES AVAILABLE. <br />
