<br /> <br />In accordance with Rule 4.14.1(2)(f)(iv), all coal seams have been covered. There are <br />no toxic- or acid-forming materials exposed at the site. <br />In accordance with Rule 4.14.1(2)(f)(v), this rule is not applicable since all available <br />spoil has been used to reclaim the site. <br />In conclusion, the site highwalls have been eliminated in compliance with all provisions of Rule 4.14, <br />including 4.14.1(2)(f). <br />Nearly all drainage at the site reports to the Coal Sales Yard sediment pond located near the entrance <br />site. Avery small azea located along the southwest edge of the site reports to a silt fence. The site <br />is erosionally stable, with no evidence of erosion noted during the November 21, 1995 inspection. <br />The entire coal sales yard has been seeded and mulched. <br />Exploration Wells <br />The three exploration wells were inspected and found to be reclaimed as required. The appropriate <br />abandonment report was filed with the Division on August 16, 1993. The holes are marked as <br />required. The hole sites can barely be distinguished from the surrounding terrain. <br />Summary and Conclusions <br />Based upon a review of the mine permit, the applicant's bond release application, and site inspections, <br />the Division fmds that Twin Pines Investment, Limited Partnership, has completed backfilling, grading <br />and drainage reestablishment at the Twin Pines No. 2 Mine site, the Coal Sales Yazd site, and at the <br />exploration drill holes, in accordance with the approved reclamation plan. Areas specifically excluded <br />from this fording are the sediment ponds at the Twin Pines No. 2 Mine site and the Coal Sales Yazd, <br />and groundwater monitoring well TP-1. <br />Phase H <br />Phase II Bond Release has not been requested, nor does it apply to the Twin Pines No. 2 Mine site <br />or the Coal Sales Yazd. However, Phase II Bond Release has been requested for the exploration drill <br />holes. The exploration drill hole locations are extremely small, and they are barely discernable from <br />the surrounding terrain. <br />Summary and Conclusions <br />Based upon a review of the mine permit, the applicant's bond release application, and site <br />observations, the Division fmds that the exploration drill hole locations exhibit groundcover consistent <br />with the surrounding terrain, and that suspended sediment yields from the extremely small hole <br />locations aze no greater than the surrounding ground. The Division fmds that the reclaimed azea <br />subject to this bond release is not contributing suspended solids to streamflow or nmoff outside the <br />permit area in excess of pre mining levels or in excess of adjacent nonmined azeas. <br />Phase III <br />Phase III Bond Release has not been requested for the Twin Pines No. 2 Mine or the Coal Sales Yard, <br />nor is such a release applicable. The operator has requested Phase HI release for the exploration <br />7 <br />
