This <br />report fulfills the requirements of Stipulation 10 of the permit. <br />The Division has made the necessary findings of compliance, which al- <br />lows mining activities as described in the application to commence in <br />the Fish Creek drainage. <br />Findings of Compliance <br />The Division has determined that Fish Creek, in the vicinity of the <br />Seneca Mine, is an alluvial valley floor (AVF). Information submitted <br />by the applicant indicates that: (1) Deposits of unconsolidated stream- <br />laid materials were identified along Fish Creek; (2) Sufficient water <br />and irrigable land is available to support flood irrigation activities; <br />and, (3) A shallow alluvial water table and vegetative species indicate <br />the presence of subirrigation. Exhibit 7-16 of Seneca's "Alluvial <br />Valley Floor Investigation of Fish Creek" (hereafter known as the AVF <br />study) delineates the extent of the alluvial valley floor along Fish <br />Creek. <br />The proposed surface coal mining <br />discontinue, or preclude farming <br />floor. Therefore, direct impacts resulting from the <br />physical disruption of alluvial or channel materials will not be <br />realized. Farming activities are not currently practiced in Fish <br />Creek in the vicinity of the Seneca Mine. Therefore, farming will <br />not be interrupted or discontinued. However, there is a slight <br />possibility that farming may be precluded on the AVF. The appli- <br />cant has identified a potential secondary impact which could affect <br />future water quality within the AVF. This is due to the leaching <br />of dissolved salts from the spoil material generated at the mine. <br />October 16, 1981 <br />
