i <br />.~ <br />20. Spouses of deceased CFiI Pensioners may be <br />entitled to receive pension benefits under the CFiI Pension Plan. <br />21. O! the 149 total Post-Petition Black Lunq Benefit <br />Beneficiaries, two (2) of those individuals are spouses of <br />deceased CFSI Pensioners that have been receiving pension <br />benefits under the CFiI Pension Plan (the "Surviving Spouses of <br />CFiI Pensioners"). A list of the Surviving Spouses of CFiI <br />Pensioners is attached hereto as Exhibit D. <br />22. Of the 149 total Post-Petition Black Lung Benefit <br />Beneficiaries, CF6I does not know the retirement ctatus of <br />thirty-five (35) of those former employees or surviving spouses <br />(the "Unknown Pensioner Status Employees or Spouses"). A list of <br />the Unknown Pensioner Status Employees or Spouses is attached <br />hereto as Exhibit E. <br />23. CFiI is certain, however, that none of the Unknown <br />Pensioner Status Employees or Spouses are eligible for or <br />receiving pension benefits under the CFiI Pension Plan. <br />7 <br /> <br />
