Of the 149 total post-Petition Black Lung Benefit <br />Beneficiaries,: ceventy-six (76) are individuals vho ware <br />employed by CFiI at some time prior to their retirement and vho <br />are entitled to receive pension benefits under the DMWA 1950 <br />Pension Plan or the UMWA 1974 Pension Plan from the UMWA 1950 <br />Pension Trust or the UMWA 1974 Pension Trust (the "UMWA <br />Pensioners"). A list of the UMWA Pensioners is attached hereto <br />as Exhibit A. <br />15. UMWA Pensioners who retired after December, 1983 <br />(the "UMWA Post-1983 Pensioners"), or Surviving Dependents of the <br />UMWA Post-1983 Pensioners are not eligible for pension benefits <br />as a consequence of their employment at CF6I because CF&I had <br />terminated all employment at the Allen and Maxwell Mines by that <br />time. <br />16. Under the UMWA 1950 Pension Plan, the UMWA 1974 <br />Pension Plan, and the UMWA 1950 Benefit Plan, spouses of deceased <br />UMwA Pensioners may be qualified to receive pension benefits <br />under the UMWA 1950 Pension Trust or the DMWA 1974 Pension Trust <br />2. The total 149 post-Petition Black Lung Beneficiaries is <br />comprised of Edward Greico, who vas lound to be eligible for <br />Black Lung Benefits after the Petition Date.
