<br />Mark W. Ogrady -2- January 28, 1994 <br />used for reclamation of this disturbance. The Division proposes to leave this disturbance in <br />its present condition at this time. <br />3. The unreclaimed mining disturbance at this location covers an estimated area of 7,500 square <br />feet and has one highwall that is approximately 25 feet tall. The Division has determined that <br />this disturbance did not result from operations conducted by TBM; as such, the expenditure <br />of monies from the forfeited TBM bond will not be used for reclamation of this disturbance. <br />The Division proposes to leave this disturbance in its present condition at this time. <br />4. Pond 15-P10 was not approved as a permanent pond in the approved reclamation plan. The <br />Division proposes to remove pond 15-P10, backfill and regrade the area to approximate <br />original contour, and plant reclamation vegetation. Priority has been characterized as <br />medium. <br />5. Pond 15-P7 1 was not approved as a permanent pond in the approved reclamation plan; <br />however, removal of pond 15-P11 would necessitate installation of an additional culvert <br />under the county road and would increase sediment loading of Del Agua Creek. The Division <br />proposes to leave pond 15-P11 for sediment control and to provide water for wildlife and <br />livestock. The approved post-mining land use is rangeland and wildlife habitat; therefore, <br />leaving pond 15-P11 would improve the land for its intended land use. The Division proposes <br />to lower the elevation of the secondary spillway and replace the protective riprap lining of the <br />secondary spillway. Priority has been characterized as medium. <br />6. Pond 15-P12 was not approved as a permanent pond in the approved reclamation plan; <br />however, removal of pond 15-P12 would necessitate installation of an additional culvert <br />under the county road and would increase sediment loading of Del Agua Creek. The roadside drainage ditch has become <br />severely eroded by uncontrolled drainage due to the blockage of culvert C-10. The Division <br />proposes to replace culvert C-10 with a 36-inch-diameter culvert and restore the road to <br />provide safe passage. Priority has been characterized as medium. The Division proposes to remove the vertical riser from the inlet end of the spillway <br />pipe, thereby converting the spillway into a culvert. Priority has been characterized as low. <br />9. Pond 22-P6 was not approved as a permanent impoundment in the approved reclamation <br />plan.
