Ogrady <br />RR 2, Box 1550 <br />Beaumont, TX 77705-9730 <br />Re: Reclamation of the Trinidad Basin Mine <br />Las Animas County, Colorado <br />Revoked Permit No. C-81-048 <br />Dear Mr. Ogrady: <br />The Colorado Division of Minerals and Geology is preparing the bid document for final reclamation <br />at the revoked Trinidad Basin Mine (TBM) site. The Division mailed a letter to you dated <br />October 15, 1993, in which the Division requested verification of property ownership boundaries <br />and comments concerning the proposed stream channel realignment. The Division has not <br />received a response to our letter dated October 15, 1993. The purpose of this second letter is to <br />describe the reclamation activities that the Division proposes to conduct on lands that may be <br />owned by you. If the Division does not receive a response to this letter by February 13, 1994, <br />the Division will assume your consent and proceed with the plans described herein, <br />Enclosed are three maps titled Map I, Map II, and Map III. Map I shows the areas that Division <br />land ownership records indicate are owned by you. Map I also shows the areas covered by <br />Map II and Map III. Map II and Map III highlight the locations of reclamation plans proposed by <br />the Division that may affect property owned by you. The circled red numbers on Map II and <br />Map III correspond to the numbered items of this letter. The reclamation items listed in this letter <br />have been characterized as possessing high, medium, or low priority based upon the Division's <br />determination of potential environmental degradation and threat to public safety. The Division <br />has prioritized the reclamation items in the event that sufficient bond is not available to complete <br />reclamation of all items listed for the entire mine site. <br />Proposed Reclamation Plans (Numbered items correspond to Map /l! <br />•1 . The unreclaimed mining disturbance at this location covers an estimated area of <br />80,000 square feet and has one highwall that is approximately 30 feet tall. The Division has <br />determined that this disturbance is not related to operations conducted by TBM. The Division <br />will not be utilizing funds from the bond forfeited by TBM for reclamation of disturbances not <br />associated with the TBM permit. The Division proposes to leave this disturbance in its <br />present condition at this time. <br />2. The Division has determined that the small disturbance at this location did not result from <br />TBM operations; as such, the expenditure of monies from the forfeited TBM bond will not be <br />
