This permit termination is categorically exclude3 from the National <br />Environmental Policy Act (NEPA) process because the Federal permit and <br />mining plan approval were previously covered by the NEPA process (i.e., <br />OSMRE's Environmental Assessment and Finding of 1]o Significant Impact <br />dated January 13, 1984) <br />II. Background <br />The Chimney Rock Cosl surface coal mine is located in Archuleta County, <br />Colorado, about 22 miles west of Pagosa Springs, Colorado, on State <br />Highway 151. The Colorado State permit area contains approximately 190 <br />acres, approximately 47.5 acres of which are leased Federal coal in the <br />mining plan area for Federal lease C-34886. <br />The Chimney Rock Coal mine mining plan was originally approved under the <br />Federal lands program on January 23, 1984, and the mine was permitted by <br />OSMRE under the Federsl lands program and Colorado State program on <br />January 24, 1984. Since the original approval of the mining plan, there <br />have been no mining plan modifications. <br />OSMRE's Albuquerque Field Office was consulted on November 10, 1988 and <br />has indicated that no pending enforcement actions are associated with <br />the Federal permit for the Chimney Rock Coal mine. <br />The Federal permit contained 13 special conditions of approval including <br />two mining plan conditions required by the Bureau of Land Nanangement <br />(BLM) and State permit stipulations 2 through 12. <br />The two conditions required by BLM required auger mining in certain <br />areas and are carried forward as special conditions of the mining plan <br />approval. <br />State Stipulation 2 required ground water monitoring parameters and is <br />carried forward in the State permit as Stipulation No. 14. <br />State Stipulation 3 required installstion of dewatering devices on <br />sedimentation ponds and was satisfied (see State's Findings of <br />Compliance dated February 1988)• <br />State Stipulation 4 required designs to control erosive velocities in <br />ditches an3 was satisfied (see Stste's Findings of Compliance dated <br />February 1988). <br />State Stipulation 5 required surface water monitoring parameters and is <br />carried forward in the State permit as Stipulation No. 5• <br />State Stipulation 6 required salvage and replacement of topsoil and is <br />carried forward in the State permit as Stipulation No. 6. <br />
