A minor revision vas <br />approved after issuance of the violation. The civil penalty was <br />fixed at the assessment conference. <br />Civil Penalty: $100.00; NOV terminated <br />S. NOTICE OF VIOLATION 12/81 NOV I181-49 <br />Construction and relocation of powder magazine prior to Division <br />approval. A minor revision to relocate a powder storage area has <br />been submitted to the Division prior to the issuance of this <br />violation. Construction activities began a few days before Division <br />approval. The revision was approved shortly after the violation was <br />issued. A civil penalty was fixed at the assessment conference held <br />in February 1982. <br />Civil Penalty: $950.00; NOV terminated <br />C. NOTICE OF VIOLATION 3/82 NOV 1182-9 <br />Discharge via the emergency spill way of sediment pond 002. Water <br />being pumped from the pit to the pond exceeded the holding capacity <br />and resulted in a discharge from the emergency spillway. Chimney <br />Rock Coal held a temporary approval to discharge water from the <br />sediment pond from the Colorado Department of Health. It was felt <br />by the Division that more pond capacity was needed. To abate the <br />violation, water was discharged when weather permitted. The civil <br />penalty was fixed at the assessment conference held in May 1982. <br />Civil Penalty $200.00; NOV terminated <br />D. NOTICE OF VIOLATION 11/82 NOV if82-50 <br />An assessment conference was held in .lanuary 1983 and Chimney Rock <br />Coal presented a case before the Mined Land Reclamation Board on <br />March 24, 1983. Civil penalties were fixed at that time. The <br />following is a summary of those violations. <br />Conducted mining activity outside of the approved mining limits. <br />Civil Penalty: $5,000 <br />2-13 <br />
