A fence was installed to protect the <br />revegetation. <br />An assessment conference was held on July 6, 1984 and a civil <br />penalty was assessed in the amount of $1,350.00. NOV terminated <br />7/6/84. <br />Notice of Violation C-84-034 (3/8/84) <br />Act Section(s) 34-33-120(2)(j) <br />Regulation Section(s) Rule 4.05.3(3) <br />Failure to stabilize and maintain diversion ditches. <br />The diversion ditches were repaired and or reconstructed. <br />An assessment conference was held on July 6, 1984 and a civil <br />penalty of $464.00 was assessed. Specifically, <br />constructing a diversion ditch which was not approved by the <br />Division. <br />A technical revision was submitted in order to bring the ditch into <br />compliance. An assessment conference was held on July 6, 1984 and a <br />civil penalty of $400 was assessed. NOV terminated 6/12/84. <br />Notice of Violation C-84-036 (3/8/84) <br />Act Section(s) 34-33-120-(2)(j)(II)(A) <br />Regulation Section(s) 4.05.6(8)(8) <br />Failure to stabilize the pond embankment with respect to erosion by <br />establishing a vegetative cover. <br />The problem was mitigated by previous seeding and new fencing. With <br />further information the Division agreed that the material in <br />question was not a pond embankment, but rather an overburden <br />stockpile, and as a result it was not subject to the same <br />requirements for stabilization and vegetative cover. <br />N.O.V. was vacated on July 9, 1984. <br />2-21 <br />
